Your access to and use of this website, as well as all related websites operated by Brainfit World 2024 Limited (including, but not limited to, www.brainfit.world, www.brainfit.academy and other associated domains) (collectively the “Site”) is subject to the following Terms of Use and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, these Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect.

  1. Scope of Services

Brainfit World 2024 Limited (“Brainfit”, “we”, “our”, “us”) provides a range of products and services designed to support brain health, memory, and lifelong learning. These include but are not limited to:

  • Online self-paced courses
  • Books, e-books, and downloadable resources
  • Workshops and seminars
  • Accredited Brainfit® Coach Training and professional development modules
  • Free articles, blog posts, newsletters, and social media content

By purchasing or engaging with any of these services or resources, you (“Client”, “you”, “your”) agree to abide by these Terms.

  1. Copyright & Intellectual Property

All Brainfit materials, including but not limited to course content, books, guides, workbooks, videos, audio files, workshop slides, handouts, and website content, are protected by copyright.

  • You may not reproduce, share, publish, transmit, distribute, or commercially exploit any materials without prior written permission from Brainfit World 2024 Limited.
  • Training materials provided to Accredited Coaches are licensed for personal teaching use only and may not be used to train other coaches or resold.
  • All trademarks, product names, and brand elements remain the property of Brainfit World 2024 Limited.
  1. Client Responsibility

Brainfit programmes, workshops, and resources are provided for educational and informational purposes only.

  • You accept full responsibility for your use of our materials, your progress, and your outcomes.
  • Results will vary depending on personal commitment, practice, and circumstances.
  • Nothing provided by Brainfit should be considered a substitute for professional medical, legal, financial, or therapeutic advice.
  1. Confidentiality
  • Some services (such as Coach Training) involve access to private learning communities or confidential materials. These must not be shared outside the agreed context.
  • Both you and Brainfit agree to protect each other’s confidential information.
  1. Privacy

We respect your privacy. Please see our separate Privacy Policy for details on how we collect, use, and protect your information.

Both Parties will keep private information in strictest confidence and shall use their best efforts to safeguard the confidential information and to protect it against disclosure, misuse, espionage, loss, and theft.

  1. Payments & Financial Obligations
  • Payment is required in full or via agreed instalments before access to paid courses, workshops, or materials is granted.
  • We accept major credit cards and (for NZ clients) direct bank transfer.
  • You are responsible for completing all payment obligations. Unpaid balances may be subject to collection.
  1. Refunds & Guarantees
  • Due to the digital nature of many of our products, refunds are generally not provided.
  • Certain courses (e.g. Brainfit® Coach Training) may include a conditional guarantee, requiring full participation and evidence of engagement before refund requests are considered.
  • All refunds, where offered, remain at the sole discretion of Brainfit World.
  1. Subscriptions & Access
  • Access to online courses and materials is for individual use only, unless otherwise specified.
  • Course enrolments may not be transferred or shared.
  1. Accreditation & Professional Use

For those completing the Brainfit® Coach Training:

  • Accreditation is granted upon successful completion of required modules and assessments.
  • Accreditation allows you to deliver Brainfit® for Life classes but does not authorize you to train other coaches or modify programme materials.
  • An annual licencing fee applies for marketing support and listing on Brainfit platforms.

 

  1. Disclaimer of Warranties
  • All content is provided “as is” without warranties of any kind. Neuroscience discoveries are evolving and, while endeavouring to update materials from time to time, Brainfit®World  Ltd assumes no responsibility for errors or omissions that may appear in any training materials.
  • We do not guarantee that our services will meet your expectations, produce specific results, or be free of errors.
  • You agree not to hold Brainfit liable for decisions, actions, or outcomes arising from your use of our content.
  1. Limitation of Liability

To the maximum extent permitted by law:

  • Brainfit World 2024 Limited shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of our services or materials.
  • Any claims must be brought within 100 days of the event giving rise to the claim.
  1. Dispute Resolution

Any disputes will first be addressed through good-faith negotiation. If unresolved, disputes will be referred to arbitration in New Zealand under New Zealand Arbitration Law.

  1. Independent Contractor Status

If you are an Accredited Brainfit® Coach, you operate as an independent contractor, not an employee, partner, or representative of Brainfit World 2024 Limited.

  1. Amendments

We may update these Terms of Use from time to time. The “Last Updated” date at the top of this page indicates the latest version. Continued use of the Site or our services constitutes acceptance of any changes.
